TERMS AND CONDITIONS February 2014


Before a booking is valid the following must be fulfilled.
1.  We must receive the completed and signed Guest Registration Form. All persons included on this form are bound by the following terms and conditions.
2.  The Guest Registration Form must be filled in by the party leader who must be over  18 years of age.
3.  The party leader is responsible for all matters relating to the booking.
4.    When confirmation in writing is received we, will keep the booking open for 7 days, to allow for transfer of 30% deposit which is non-refundable? After receipt of the deposit we will issue the booking confirmation, and forward this to the client.

Payment Terms:
1. Full payment for the rented property must be received no later than 6 weeks before the start of the rental period.
2. Full payment will be required immediately if a booking is made less than 4 weeks prior to the start of the rental period.
3. Payment for rental is by direct debit only to our nominated Bank Account
4. If the final payment is not received by the date requested, we reserve the right to cancel the booking and apply cancellation charges as stated below. We will notify you two weeks before the final payment.
5. The client must pay all Bank charges.

Cancellations:
Cancellations must be made in writing. Any notification of a cancellation after full   payment is received will attract the following charges:
50% charged if cancelled within 8 weeks
75% charged if cancelled within 4 weeks
100% charged if cancelled within 7 days
The client must pay all bank charges if the refund is made by bank transfer.

Note: No refund of the deposit will be made.


General Conditions - Before & during occupancy of the rented property
1.  Please inform us of your arrival and departure time at least two weeks prior to the start of your holiday on the Guest Holiday Rental Form. This will help us to give you a better service and avoid waiting time at check-in and check-out to the holiday accommodation.
2.  If you arrive after 22.00 there will be a charge of $ 20 to check you into the holiday rental property.
3.  The client agrees to maintain the holiday rental property and its contents in the same condition as at the beginning of the stay. The client must inform us of any breakages, losses or damage to the property during their stay, and accept responsibility for the cost of any damage caused by him or his party or any additional cleaning charges.
4.  If we become aware that the number of persons exceeds the number stated on the booking form, then we reserve the right to terminate the booking without any refunds.
5.  Any extra charges incurred during the rental period will be charged separately and must be settled before departure by cash or credit card.
6.  A refundable $200.00 cash security deposit may be taken upon arrival, and if applicable will be noted on the booking form. The deposit will be refunded provided the holiday rental property, on inspection, is left in a clean and tidy condition. If the holiday rental property is left in an unreasonable condition, then the costs for cleaning, breakages and repairs will deducted from the cash security deposit. If the guests vacate the holiday rental property without an inspection by our villa manager, then the deposit will be forwarded to the guest's nominated bank account within 10 working days of the departure. The deposit is subject to adjustment for cleaning, breakages or damage.
7.  If the departure time is between 00.00hrs and 08.00 the deposit will be transferred to a bank account of the guests choice once the property has been inspected (The client must pay all Bank charges)
8.  Clients are responsible for the keys to the holiday rental property. If the keys are lost there will be a replacement charge of $10 per key.
9.  Fresh bed sheets and towels and beach towels will be provided.
10. Properties are available after 15.00 on the day of arrival and must be vacated by   12.00 on the day of departure, unless previously agreed in writing. Special Functions and Events Special events may be  held in the villas on request. We can help with arranging these and the request should be communicated before booking the villa. We are obliged to notify neighbors and the local banja of special events that may generate more people, noise, and use of facilities other than normal. Permission must be given before any event is held and consideration of other villa guests must be respected.

We are happy to assist with arranging events, and catering. Shopping and decorations, entertainment will be charged to the villa separately with at 25% surcharge.
If our Villa Management or its staff, or our security personnel feel that there is a serious risk of damage to the villa or its surrounds/neighbors, from improper use of the property, the management and/or its representatives reserve the right to repossess the property.
Drugs  Drugs are not permitted on the villa premises. Extremely harsh penalties exist in Indonesia for possession or use of illegal drugs.

Smoking
We have a strict non-smoking policy inside the villa, which is enforceable through local government regulation.  Smoking is permitted in designated outdoor areas, and those areas are clearly identified with signs stating "preferred smoking area". We ask that you consider the environment by disposing of cigarettes butts safely in the ashtrays provided outdoors.

Liability Waiver And Indemnity
All guests staying at Villa Sindhu are required to agree to the terms of this release, indemnity and waiver of liability and all other terms and conditions as detailed in our reservation documents prior to use of the property which is evidenced by execution of this agreement.
THE UNDERSIGNED hereby certifies that he/she and guests (they) have adequate insurance to cover any injury or damage that may be caused or suffered while in or upon the property, or else agrees to bear the costs of such damage or injury. The undersigned agrees further that he/she/they have no medical conditions which would interfere with use of the property and its facilities, etc or else assume and bear the costs of all risks that may be created directly or indirectly, by any such condition and expressly acknowledges such use of the property and its facilities are potentially dangerous and could involve the risk of serious and/or death and/or property damage. The undersigned further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, not withstanding, continue in full legal force and effect.

The undersigned hereby releases, waives, discharges and covenants not to sue the owners of Eleven Kejora,  their managers, agents or servants personally and as a company or corporate representatives, their members, managers, operators , officials, officers, directors, employees, owners and/or lessees of the premises , all for the purpose herein referred to as "releases" from all liability to the undersigned , guests, representatives, assigns, heirs and next of kin for any and all loss and damage , and any claim or demand thereof on account of property damage , illness or injury to the persons(s), or resulting in death of the undersigned or guests, whether caused by negligence of the releases  or otherwise while in or upon the area.
